Terms and Conditions

NOTE: THIS IS A MANUALLY REVISED AUTOMATIC TRANSLATION OF THE GERMAN TERMS AND CONDITIONS (AGB). IT IS ONLY PROVIDED FOR THE CONVENIENCE OF OUR NON-GERMAN-SPEAKING CUSTOMERS. THE GERMAN VERSION IS LEGALLY BINDING.

§ 1 General
These terms and conditions apply to all contracts for goods that you buy as a customer from Retrode UG (haftungsbeschränkt), Liesbet-Dill-Str. 14, 66125 Saarbrücken, verkauf@retrode.com, hereinafter "we". By placing an order, you declare that you agree with these terms and conditions. Different rules shall only be valid if they are agreed to in writing between us as a seller and you as a customer.

§ 2 Scope and contractors
(1) All our deliveries are exclusively subject to the following terms of sale. Different conditions are binding on us only after explicit approval.
(2) Your contract partner for all orders is Retrode UG (haftungsbeschränkt) (contact address, see end of AGB)

§ 3 Delivery area and customer base
Orders and deliveries are possible worldwide. For orders from countries other than the following, we ask for prior consultation:
States of the European Union, United States of America, Canada, Australia, Japan.

§ 4 Order and contract
(1) You order in our shop by
a) selecting articles from our range
b) entering your billing and shipping address and contact details
c) verifying the accuracy of your information and then clicking on the button "submit order".
(2) After submission, you will receive a copy of the order via e-mail. This receipt does not constitute acceptance of your offer, but simply informs you that your order is received. At the same time you are asked to make a payment by bank transfer or online payment service PayPal.
(3) The contract of sale becomes effective by the the shipment of the goods or a written order confirmation.
(4) Contracts in our online shop can be concluded only in German language.

§ 5 Storage of order data

Your orders are stored. If you lose your documents to your orders, please contact via email / phone us. We will send you a copy of your order details.

§ 6 Withdrawal
(1) If you are a consumer within the meaning of § 13 BGB, you have a right of withdrawal referred to in the annex attached below, where the consequences are also shown.
(2) The right does not apply
- If the goods are manufactured according to customer specifications or clearly tailored to personal needs or are not suitable for their state for a return or spoil quickly or their expiration date was exceeded,
- For delivery of audio or video recordings or software if the delivered data carriers have been unsealed by you,
- For deliveries of newspapers, periodicals or magazines.
(3) Deliveries abroad: please contact us in advance of a necessary return shipment.

§ 7 Prices and Payments
(1) The prices are understood to be final prices. They include all price components, including the legal German VAT, which is shown separately. The exact amount of packaging and shipping is also shown separately.
(2) If necessary, other taxes or fees can be invoiced by third parties (e.g. customs).
(3) For customers outside the EU we will not charge VAT. Please note, however, that duties may apply upon placing a shipment, which will be invoiced separately.

§ 8 Delivery
(1) Unless otherwise agreed or otherwise indicated on the items, we ship within 15 business days after receipt of your payment, but usually within a few days. This is under the proviso that we are provided properly and on time and do not represent the unavailability. Information about the delivery date are not binding, unless in exceptional cases, wherethe delivery date has been confirmed.
(2) For items that are made only after receipt of order, longer lead times can apply. This is noted in the item description.
(3) In case of a delay, we will inform you immediately by e-mail.

§ 9 Payment
We offer the following payment methods:
a) Advance payment (bank transfer)
b) PayPal
c) after prior consultation: cash on collection

§ 10 Partial deliveries
In order to fulfill a transaction, we can execute partial deliveries. The packaging, shipping and insurance costs will be charged only once.

§ 11 Warranty
The statutory limitation period for defect claims is 2 years (for second-hand items: 1 year, for customers outside the EU generally 6 months), beginning with the date of the deposit, i.e. the delivery to the buyer.

§ 12 Transport damage
If delivered items have obvious transport damages, please immediately report such mistakes to us or the carrier who delivers the articles. This is not required if you are a private customer, but we'd really appreciate your note so we can assert a claim against the carrier.

§ 13 Choice of law
((1) performance and jurisdiction for both parties is - if the customer is a businessman - the seat of our company, even in the bills and checks. We are also entitled to sue the customer at his general jurisdiction.
(2) All legal relations between us and the customer are exclusively subject to the laws of the Federal Republic of Germany to the exclusion of German international private law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

The subsequent withdrawal does not apply if the goods you ordered will be used for your own commercial or independent professional activity.

Right to withdrawal
If you are a consumer according to § 13 BGB, you can cancel your contract within two weeks without giving reasons in writing (eg letter, e-mail) or by returning the goods. The period begins with receipt of the goods and this instruction. Within this period, it is sufficient to send the declaration of withdrawal or the goods to the address listed below (see "Identification of Providers")

Consequences of Withdrawal
In case of an effective cancellation the mutually received benefits and possibly towed uses (eg interest) have to be returned. If you are not able to return the matters whole or in part, or they are in deteriorated condition, you have to pay us compensation for the value. This does not apply if the deterioration is solely cased by the examination of the goods - as it would have been possible in a shop. In addition, you can avoid the obligation to pay compensation by not using the goods like an owner, and omitting everything which impairs their value. You have to bear the cost of the return if the delivered goods are the ordered ones and if their price does not exceed 40 Euros, or otherwise if you have received the goods but not yet provided the payment. Otherwise, for EU customers the return is free. To avoid unnecessary costs (eg bulky goods) the shipment should be coordinated with us beforehand.
